1. Acceptance of Terms

By creating an account or using Legati, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, do not use the service.

2. Description of Service

Legati is an encrypted file storage service operated by Infragilis LLC. We provide secure, AES-256-CBC encrypted file storage with unique per-user encryption keys. Files are stored locally and periodically bundled, encrypted, and uploaded to secure storage.

3. Account Responsibilities

• You must provide accurate and complete registration information.
• You are responsible for maintaining the confidentiality of your password and encryption key.
• You are responsible for all activity that occurs under your account.
• You must notify us immediately of any unauthorized use of your account.

4. Acceptable Use

You agree not to use Legati to:

• Store or distribute illegal content
• Violate any applicable laws or regulations
• Infringe on the intellectual property rights of others
• Attempt to gain unauthorized access to the service or other users' data

5. Intellectual Property

You retain all ownership rights to the files you upload. Legati does not claim any ownership of your content. The Legati platform, brand, and technology are the intellectual property of Infragilis LLC.

6. Payment and Subscriptions

Access to file storage requires an active subscription. Subscription plans and pricing are displayed on the subscribe page. Payments are processed securely through Stripe. Subscription terms and storage limits are as described at the time of purchase.

7. Encryption Key Responsibility

Each user receives a unique encryption key upon registration. This key is essential for accessing your encrypted files. Legati cannot recover lost encryption keys or decrypt files without the original key. You are solely responsible for safely storing your encryption key.

8. Termination

You may delete your account at any time through your profile. Account deletion permanently removes all your personal data, files, and associated records. Legati reserves the right to suspend or terminate accounts that violate these terms.

9. Limitation of Liability

Legati is provided "as is" without warranties of any kind. Infragilis LLC shall not be liable for any indirect, incidental, or consequential damages arising from the use of the service, including but not limited to data loss due to lost encryption keys, service interruptions, or unauthorized access to your account.

10. Governing Law

These terms are governed by the laws of the United States. For users in the European Union, nothing in these terms affects your rights under the GDPR or other applicable consumer protection laws. For California residents, nothing in these terms affects your rights under the California Consumer Privacy Act (CCPA/CPRA). Nothing in these terms limits your rights under the Health Insurance Portability and Accountability Act (HIPAA).

11. Changes to Terms

We may modify these terms at any time. Changes will be posted on this page with an updated revision date. Continued use of Legati after changes constitutes acceptance of the revised terms.

12. Legati SMS Messaging Program

Legati offers an optional SMS messaging program ("Legati SMS Alerts") that provides account security and notification messages to registered users who opt in via their profile settings.

By enabling SMS features, you may receive the following types of messages:

• Two-factor authentication (2FA) verification codes for login
• One-time passwords for account recovery and password reset
• Account security alerts (profile changes, delegate access)
• File upload confirmations

Message frequency varies based on your account activity. You may receive up to approximately 10 messages per month, depending on how often you log in and use the service.

Message and data rates may apply. Your carrier's standard messaging and data fees will apply to any messages you send or receive. Legati does not charge for SMS messages, but your mobile carrier may.

You can opt out of SMS messages at any time by replying STOP to any Legati message, or by disabling SMS features in your profile settings. After opting out, you will receive one final confirmation message. Note: opting out of SMS will disable two-factor authentication if it was enabled.

By enabling SMS features on your Legati profile, you expressly consent to receive automated text messages from Legati at the phone number you provided. Consent is not a condition of purchase or use of the service.
